JURISDICTION OF HIGH COURTS IN INDIA

All High Courts in India have original, writ, appellate and supervisory jurisdiction.

  1. Original Jurisdiction: In many cases, the High Court has been provided with a power to hear the issue in the first instance and not as an appeal. Such matters generally pertain to infringement of fundamental rights. Other matters include admiralty, will, marriage, divorce, company laws and contempt of court.

 

  1. Writ Jurisdiction: The constitution of India under Article 226 provides power to the High Court to hear Writ Petitions in order to effectuate fundamental rights.
